Administered Matters: Effective ADR Solutions

Step 1:

The Gauteng Directive and Protocol provide clear guidance that the parties are to submit and respond to the Rule 41A notices. These notices include a selection of at least three mediators from our ADR platform, which is dedicated to offering effective dispute resolution services. Agreeing on a mediator is your first successful step in the mediation process to resolve the dispute. Step 2

To initiate the mediation process on our ADR platform, please load your matter and add all relevant documents and details as prompted by clicking here: ADR Request Service

It is essential that you enter the names of the Plaintiff and Respondents, rather than their representing attorneys.

Additionally, please upload your Rule 41A notices and responses, along with any communication that confirms the appointment of the mediator involved in your dispute resolution services.

A one-time admin fee of R 1,000.00 excl VAT will be invoiced once your matter is loaded. Please be aware that failure to pay this invoice within 5 days will result in your matter being deleted from the platform.

Step 3

Our ADR platform will send both parties an email requesting more information about the mediator agreement and the mediator fees associated with our dispute resolution services. Once both parties have submitted their information, we will assign the chosen mediator to oversee the mediation process. The system will then notify all parties via email about the appointment and the next steps, after which the mediator will reach out to arrange your first meeting.

Step 4

The parties will meet with the mediator as part of the mediation process to discuss the dispute until a resolution is reached. Throughout this discussion, the mediator will update the status of the matter and include any additional documents as required, utilizing the dispute resolution services available on the ADR platform.

Step 5

At the end of the mediation process, whether it is successful, partially successful, or unsuccessful, the mediator will prepare a mediator's report along with a joint minute. These documents will be signed and uploaded to our ADR platform for reference.
